Welcome to EthnicBNB. These Terms of Service explain the rules for using our website, mobile platform, booking tools, hosting tools, messaging tools, payment flow, support services, and all other services connected with EthnicBNB.

By using EthnicBNB, you agree to follow these Terms. This applies when you browse the platform, create an account, search for a stay, make a booking, list a property, send messages, accept payments, write reviews, contact support, or use any feature connected with EthnicBNB.

Please read these Terms carefully. We have written them in simple language so that guests, hosts, and visitors can understand their rights and responsibilities clearly.

EthnicBNB is a marketplace and facilitator. We help guests discover and book stays, homestays, cultural stays, local experiences, food-preference-friendly stays, language-friendly listings, and host-managed accommodation options. Unless clearly stated in writing, EthnicBNB does not own, operate, manage, inspect, or control the properties listed by hosts.

Hosts are responsible for their own listings, properties, permissions, safety, pricing, rules, taxes, guest records, and legal compliance. Guests are responsible for reading listing details, following house rules, providing correct information, paying through the platform, and using the stay respectfully.

Our food, language, culture, religion, ethnicity, identity, and local-experience filters are discovery tools only. They are meant to help users find relevant information and comfort preferences. These tools must never be used to discriminate, exclude, harass, insult, refuse lawful service, or treat any person unfairly.

Section A — About EthnicBNB

1. Introduction

These Terms of Service form an agreement between you and EthnicBNB. The words “you” and “user” mean any person who uses the platform. This includes guests, hosts, visitors, account holders, property owners, property managers, service providers, and anyone using EthnicBNB on behalf of a business, family, group, or organisation.

When you use EthnicBNB, you also agree to the other public policies shown on our platform. These may include the Privacy Policy, Cancellation Policy, Payments page, Hosting Agreement, General Terms, Disclaimer, Information page, and any other policy that applies to your activity.

These policies are part of your overall agreement with EthnicBNB. For example, if you make a booking, the Cancellation Policy and Payments page may apply. If you list a property, the Hosting Agreement may apply. If you upload content or share personal information, the Privacy Policy and content rules may apply.

If you do not agree with these Terms, you should not use EthnicBNB.

EthnicBNB may update these Terms from time to time. When we update them, we may change the “Last updated” date. Where required or where reasonably possible, we may also notify users about important changes. Your continued use of the platform after changes means you accept the updated Terms.

2. What EthnicBNB Offers

EthnicBNB helps guests and hosts connect for travel, accommodation, homestays, cultural stays, local stays, and related hosting services.

Guests may use EthnicBNB to search for stays, compare listings, apply filters, check prices, send booking requests, make payments, communicate with hosts, view booking details, cancel bookings where allowed, write reviews, and contact support.

Hosts may use EthnicBNB to create listings, upload property details, add photos, manage prices, manage availability, communicate with guests, accept or manage bookings, receive payout support, and maintain hosting records.

EthnicBNB may also provide tools for search, maps, filters, messaging, reviews, bookings, cancellations, payments, refunds, identity-related information, food preferences, language preferences, and cultural discovery.

These tools are provided to make the platform easier and more useful. However, they do not remove the responsibility of guests and hosts to check important details before booking, hosting, travelling, or accepting a guest.

EthnicBNB may improve, change, pause, remove, or update platform features from time to time. Some features may not be available in all locations, for all users, or for all bookings.

3. Important Definitions

For these Terms, the following meanings apply:

Guest means a person who searches, books, pays for, visits, or stays at a property listed on EthnicBNB.

Host means a person, company, property owner, manager, authorised representative, or service provider who lists or manages a stay on EthnicBNB.

Listing means a property, room, apartment, homestay, cultural stay, local stay, experience, service, or related information shown on the platform.

Booking means a reservation that is confirmed through the platform according to the booking and payment flow.

Platform means the EthnicBNB website, mobile platform, admin tools, host tools, booking tools, payment flow, communication tools, and related services.

Content means text, photos, videos, listing details, reviews, messages, documents, profile information, descriptions, and any other material uploaded, posted, sent, or shared by users.

Service Fee means any platform fee, commission, convenience fee, technology fee, or other charge applied by EthnicBNB where applicable.

Payment Partner means a bank, payment gateway, card network, wallet provider, UPI provider, currency service, or any third-party payment provider used to process payments or payouts.

4. Inclusive Search and Cultural Discovery

EthnicBNB supports respectful travel, cultural discovery, and inclusive hosting. Some users may want to find stays based on food options, language comfort, local culture, religious information, identity-related information, ethnic background, or community-friendly experiences. EthnicBNB may provide filters or information fields to help users discover these details.

These filters are for information and comfort only. They must not be used to discriminate against anyone. A user must not use EthnicBNB to deny lawful service, insult, exclude, harass, threaten, shame, or target another person based on religion, ethnicity, caste, race, nationality, language, gender, disability, food habit, identity, culture, or any protected characteristic under applicable law.

Hosts may describe their property, food options, language support, cultural setting, and local experience honestly. However, hosts must not use listing information to create unfair, illegal, or discriminatory conditions.

Guests may use search filters to understand comfort, food, language, culture, and local information. However, guests must use these tools respectfully and must not pressure hosts to act unlawfully or unfairly.

EthnicBNB may remove content, limit features, suspend accounts, cancel bookings, or take other action if these tools are misused.

5. Eligibility and User Responsibility

You must be at least 18 years old and legally capable of entering into a contract to create an account, make a booking, list a property, or accept payment through EthnicBNB.

You agree to provide true, complete, and updated information when using the platform. This may include your name, contact details, identity information, payment information, travel details, property details, tax information, payout details, and any other information required for safe and lawful platform use.

You are responsible for keeping your login details secure. Any activity done from your account may be treated as your responsibility unless you can show that your account was misused without your fault.

You must use EthnicBNB only for lawful purposes. You must not use the platform for fraud, illegal stays, false bookings, fake listings, harassment, spam, hacking, scraping, data misuse, off-platform payment demands, or any activity that harms users, hosts, guests, payment partners, or EthnicBNB.


Section B — Guest Terms

6. Searching and Filtering

Guests can search for stays using location, dates, number of guests, price, property type, amenities, food preferences, language preferences, cultural information, host details, availability, and other filters.

Search results may depend on many factors, including your selected location, dates, price range, availability, host settings, ranking system, guest preferences, map area, platform safety checks, technical performance, and listing information provided by hosts.

EthnicBNB tries to show useful and relevant information, but search results are not a guarantee that a property will be available, suitable, safe, legal, or exactly as expected. Listing details may change due to host updates, seasonal conditions, local rules, pricing changes, availability changes, or third-party information.

Guests should carefully read the full listing before booking. This includes the property description, room type, amenities, food details, location, map area, house rules, check-in and checkout rules, cancellation terms, price breakdown, taxes, fees, safety notes, accessibility information, and any special conditions.

If something is important to your stay, you should confirm it before booking. This may include food availability, distance from a location, parking, lift access, Wi-Fi, air conditioning, kitchen access, bathroom type, language support, pet rules, guest capacity, or local travel restrictions.

7. Booking Process

A booking is confirmed only when the platform, host settings, and payment flow show that the booking is confirmed. A search result, message, booking request, payment attempt, payment hold, or conversation with a host does not by itself guarantee a confirmed booking.

Some listings may allow instant booking. Other listings may require host approval. Some bookings may also require successful payment, identity verification, fraud review, guest details, legal records, or other checks before confirmation.

You should not assume that your travel is confirmed until you receive proper confirmation through EthnicBNB. EthnicBNB is not responsible for costs caused by a guest making travel plans before a booking is confirmed.

Hosts may accept or decline booking requests based on lawful availability, property rules, guest capacity, safety reasons, payment status, or other permitted reasons. Hosts must not decline bookings for illegal or discriminatory reasons.

A confirmed booking gives the guest permission to stay according to the listing details, booking dates, house rules, payment status, and any conditions shown during the booking process. It does not give the guest ownership rights, tenancy rights, or permanent rights over the property.

8. Guest Responsibilities

As a guest, you agree to use EthnicBNB and the booked property responsibly.

You must read the listing carefully before booking. You must check the stay dates, number of guests, total price, cancellation rule, house rules, check-in instructions, location details, food options, amenities, safety information, and any additional charges shown before payment.

You must provide accurate guest details and travel information. If local law requires identity proof, guest records, foreign guest records, police reporting, C-Form submission, or other documentation, you must cooperate with the host and provide lawful and accurate information.

You must treat the property, host, neighbours, staff, and local community respectfully. You must not damage property, disturb neighbours, break house rules, bring extra guests without permission, misuse amenities, conduct illegal activities, or create safety risks.

You must not ask hosts to accept payment outside the platform where the platform requires payment through EthnicBNB. Off-platform payments may reduce your protection, create fraud risks, and violate these Terms.

You are responsible for your own travel decisions. You should check local laws, travel restrictions, health requirements, transport conditions, safety risks, weather, personal needs, and suitability of the property before booking.

If you damage property, violate rules, bring unauthorised guests, fail to check out on time, or cause loss to a host, you may be responsible for reasonable charges, claims, or legal consequences.

9. Booking Fees and Total Price

The final payable amount should be shown before payment. Depending on the booking, the total price may include stay price, room charges, cleaning charges, meal charges, extra guest charges, service fees, taxes, payment gateway charges, discounts, currency conversion, and other booking-specific charges.

The price shown during search may not always be the final payable amount because taxes, fees, discounts, currency conversion, or booking-specific charges may be applied later in the checkout flow.

Guests should review the full price breakdown before payment. Once a booking is confirmed, the price, refund rule, and payment record connected with that booking will apply, subject to applicable law and platform policies.

Fees, taxes, gateway charges, service fees, host payout rules, and refund treatment must match the booking flow, admin settings, payment records, and applicable policies. This page gives general rules and should not be treated as a fixed price promise for every booking.

If a price appears clearly wrong because of a technical error, currency issue, listing error, or system problem, EthnicBNB may review the booking and take reasonable action according to platform policy and applicable law.

10. Cancellations and Refunds

Cancellation and refund outcomes depend on the cancellation rule displayed before payment and recorded with the booking.

A booking may have flexible, partial, strict, non-refundable, host-specific, date-specific, or platform-specific cancellation terms. Refunds may also be affected by service fees, taxes, payment gateway charges, discounts, coupons, currency conversion, host payout status, fraud review, safety concerns, legal requirements, or exceptional circumstances.

Guests should read the Cancellation Policy before booking. A refund may not include every charge paid. Some fees may be non-refundable where allowed by law and where clearly shown in the booking flow.

If a guest cancels a booking, the refund will be calculated according to the cancellation rule connected with that booking. If a host cancels a confirmed booking, EthnicBNB may help the guest with support options where reasonably possible.

EthnicBNB may review cancellation issues based on the recorded booking rule, evidence, payment records, platform policy, and applicable law.


Section C — Host Terms

11. Becoming a Host

To become a host, you may need to create an account, provide contact details, verify identity, submit payout information, provide tax details, upload property information, and confirm that you have the legal right to list and host the property.

By creating or managing a listing, you confirm that you have the authority to offer the property or service. This may mean you are the owner, lawful tenant, authorised manager, company representative, or another person legally permitted to host.

EthnicBNB may review listings, request additional information, reject listings, pause listings, remove listings, or limit host access where information is incomplete, unsafe, misleading, unlawful, suspicious, or against platform policy.

Approval or publication of a listing does not mean EthnicBNB has inspected the property or confirmed every legal requirement. Hosts remain responsible for their own compliance.

Hosts should make sure that their listing is suitable, safe, lawful, and available before accepting bookings. If the property becomes unavailable or unsafe, the host should update the listing or contact support as soon as possible.

12. Listing Standards

Hosts must create honest, accurate, and complete listings.

A listing should clearly describe the actual property, room type, location, sleeping arrangement, bathroom access, amenities, food options, accessibility details, house rules, safety information, guest capacity, price, fees, check-in process, checkout process, cancellation terms, and any important restrictions.

Photos, videos, edited images, AI-enhanced images, and descriptions must not mislead guests about size, condition, location, view, safety, cleanliness, privacy, amenities, or experience.

Hosts must keep calendar availability and prices updated. If a property is unavailable, unsafe, under repair, legally restricted, or not ready for guests, the host should update or pause the listing.

Hosts must not add hidden charges after booking unless those charges were clearly disclosed before payment and allowed by platform policy.

Hosts should provide guests with clear check-in instructions, emergency contact information where appropriate, and accurate information about property access, keys, security, parking, food, local rules, and important safety matters.

13. Host Legal Responsibilities

Hosts are responsible for understanding and following all laws, rules, permissions, and requirements that apply to their property and hosting activity.

This may include owner permission, landlord permission, society approval, NOC requirements, local body rules, municipal rules, tourism registration, lodging rules, hotel or homestay rules, fire safety requirements, building safety, police guest records, foreign guest reporting, C-Form requirements, tax laws, labour laws, food-related rules, and any other legal duty that applies.

EthnicBNB does not provide legal permission to host. Listing a property on the platform does not mean the property is legally allowed to operate as a stay. Hosts should take independent advice where needed.

If a host fails to follow the law, provides false information, hides required permissions, or causes legal issues, the host may be responsible for resulting losses, claims, penalties, refunds, guest complaints, or platform action.

Hosts must not list properties that are unsafe, illegal, unauthorised, falsely described, or not actually available for guest use.

14. Host Tax, Insurance, and Documentation

Hosts are responsible for their own tax, accounting, invoice, payout, insurance, and record-keeping obligations.

This may include income tax, GST, PAN, TDS, TCS, invoices, local taxes, tourism fees, service charges, or other tax-related duties where applicable.

EthnicBNB may request tax information, payout information, identity details, business details, or supporting documents where required by law, payment partners, fraud checks, or platform policy.

EthnicBNB may withhold payouts, report information, deduct amounts, adjust records, or cooperate with lawful requests where required by law, payment partners, tax authorities, regulators, or court orders.

Hosts are encouraged to maintain proper insurance for property damage, guest injury, fire, theft, natural events, business interruption, third-party claims, and other hosting-related risks. EthnicBNB does not guarantee that any host is insured.

Hosts should keep booking records, guest records, payment records, invoices, permissions, tax records, and safety documents for the period required by applicable law.

15. Host Conduct and Guest Privacy

Hosts must treat guests fairly, respectfully, and lawfully.

Hosts must not discriminate, harass, threaten, insult, overcharge, mislead, spy on, or misuse guest information. Hosts must not use hidden cameras or recording devices in private areas such as bedrooms or bathrooms. Any permitted security cameras or monitoring devices must be lawful, clearly disclosed, and not placed in private spaces.

Hosts may use guest information only for booking, check-in, safety, communication, legal record, tax, and support purposes. Hosts must not sell, leak, publish, misuse, or unnecessarily store guest personal information.

Hosts should respond to guests in a professional way, provide clear check-in instructions, maintain basic hygiene and safety, honour confirmed bookings, and inform guests quickly if a serious issue affects the stay.

Hosts must respect guest privacy during the stay. Hosts should not enter the guest’s private space without lawful reason, emergency need, prior notice, or permission, except where immediate safety or legal action requires it.


Section D — Platform Terms

16. Payments, Charges, and Currency

Payments on EthnicBNB are processed through authorised payment gateways, banks, card networks, wallet providers, UPI providers, currency systems, and other payment partners.

The payment methods available to a user may depend on location, currency, device, gateway settings, bank approval, risk checks, payment partner availability, and platform configuration.

Currency conversion may be shown for convenience. Exchange rates, conversion fees, bank charges, card charges, gateway charges, and settlement amounts may vary. The final payable amount should be shown before payment, but your bank or payment provider may apply its own charges.

Hosts may receive payouts according to platform payout rules, payment partner processing time, refund status, cancellation status, review status, fraud review, tax rules, and any applicable withholding.

EthnicBNB is not responsible for every delay, failure, chargeback, bank rejection, payment gateway downtime, or third-party payment issue, but we may support users where reasonable using available payment records.

Users must not make false chargebacks, use stolen payment methods, manipulate payment records, avoid platform fees, or misuse the payment system.

17. Content and Intellectual Property

Users must upload only content that they own or are authorised to use. This includes photos, videos, text, property descriptions, logos, documents, reviews, messages, and profile information.

By uploading or posting content on EthnicBNB, you allow EthnicBNB to use, display, reproduce, format, translate, publish, promote, and share that content as needed to operate the platform. This may include showing listings to guests, displaying reviews, supporting bookings, handling complaints, improving trust, promoting listings, and maintaining platform records.

You remain responsible for your content. You must not upload content that is false, stolen, misleading, hateful, illegal, private without consent, defamatory, obscene, threatening, discriminatory, or harmful.

EthnicBNB owns or is authorised to use its platform design, software, logo, brand materials, website content, database structure, search system, booking tools, and related intellectual property. Users must not copy, reverse engineer, misuse, scrape, or commercially exploit platform materials without written permission.

EthnicBNB may remove, hide, edit, or restrict content where it appears to violate these Terms, platform policy, applicable law, or the rights of another person.

18. Reviews and Community Standards

Reviews help guests and hosts make better decisions. Reviews should be honest, relevant, respectful, and based on real booking experiences.

Users must not post fake reviews, paid reviews, manipulated reviews, threats, hate speech, private information, personal attacks, spam, misleading claims, or content that violates law or another person’s rights.

EthnicBNB may remove, hide, reject, or limit reviews if they appear false, abusive, irrelevant, discriminatory, manipulated, unlawful, or against platform policy.

A review is one user’s opinion and does not always represent EthnicBNB’s opinion. Users should read reviews carefully and also check listing details, rules, photos, cancellation terms, and recent information before booking.

Users should communicate respectfully on the platform. Abusive language, threats, harassment, repeated unwanted messages, sexual harassment, hate speech, and harmful behaviour are not allowed.

19. Prohibited Conduct

Users must not misuse EthnicBNB.

The following activities are not allowed:

  • Creating fake accounts, fake identities, fake listings, or fake bookings.

  • Using stolen payment methods or false payment information.

  • Asking for or making off-platform payments where platform payment is required.

  • Posting misleading prices, hidden charges, or false property details.

  • Discriminating, harassing, threatening, abusing, or harming another person.

  • Uploading malware, spam, harmful code, or security-breaking content.

  • Scraping, copying, harvesting, or misusing platform data.

  • Manipulating reviews, rankings, search results, messages, or booking records.

  • Avoiding taxes, legal records, guest documentation, or reporting obligations.

  • Interfering with another user’s account, booking, payout, or privacy.

  • Using the platform for illegal activity, unsafe stays, human trafficking, exploitation, violence, drugs, fraud, or other unlawful purposes.

EthnicBNB may take action against prohibited conduct, including account limits, listing removal, booking cancellation, payout hold, refund adjustment, support review, legal reporting, or permanent account termination.

20. Suspension and Termination

EthnicBNB may suspend, limit, restrict, or terminate accounts, listings, bookings, messages, payouts, reviews, or platform access where needed for safety, legal compliance, fraud prevention, payment risk, user protection, repeated policy breach, or platform integrity.

Where reasonable, EthnicBNB may give users a chance to respond or provide documents. However, immediate action may be taken where there is serious risk, legal requirement, fraud concern, payment issue, safety issue, or harm to another user.

Users may stop using the platform at any time. Some information may be kept where required for legal, tax, fraud prevention, payment, complaint handling, security, or record-keeping purposes.

Termination does not remove responsibilities that already arose before termination, including payment obligations, refund obligations, tax duties, content responsibilities, or legal claims.

If an account is suspended or terminated, the user must not create another account to avoid restrictions unless EthnicBNB gives written permission.


Section E — Legal Terms

21. Platform Role and Limitation

EthnicBNB acts as a marketplace and facilitator between guests and hosts. We provide tools for discovery, booking, communication, payment support, listing management, reviews, and platform support.

Unless clearly stated in writing, EthnicBNB does not own, operate, control, manage, inspect, or guarantee the properties listed by hosts. EthnicBNB is not the landlord, hotel operator, travel agent, property manager, insurer, or legal representative of the host or guest.

To the extent permitted by law, EthnicBNB is not responsible for every host action, guest action, property condition, local event, third-party service, transport issue, weather issue, payment partner issue, bank issue, internet failure, or government restriction.

EthnicBNB does not guarantee that every listing will be available, safe, legal, suitable, accurate, or exactly as described. Hosts are responsible for their listings and properties. Guests are responsible for checking details before booking.

However, nothing in these Terms limits rights that cannot be limited under applicable law. If you have statutory rights as a consumer, data subject, taxpayer, guest, host, or platform user, these Terms do not remove those rights.

22. Indemnity

A user may be responsible for losses caused by their own unlawful conduct, false information, breach of these Terms, property damage, hidden charges, tax failure, intellectual property violation, privacy breach, discrimination, fraud, safety issue, or misuse of the platform.

This means that if your actions cause claims, penalties, losses, complaints, legal costs, payment issues, chargebacks, property damage, or harm to EthnicBNB, another user, a payment partner, or a third party, you may be required to compensate the affected party to the extent permitted by law.

Hosts may be responsible for claims connected with their property, listing, permissions, guest safety, taxes, local compliance, staff, food service, documentation, or house rules.

Guests may be responsible for claims connected with property damage, unpaid charges, rule violations, illegal activity, extra guests, misuse of amenities, false information, or harm caused during a stay.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Courts and forums at Kolkata, West Bengal, India, may have jurisdiction, subject to applicable consumer protection, privacy, payment, cyber law, tax, and other statutory rights.

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply as far as legally possible.

EthnicBNB’s failure to enforce any part of these Terms immediately does not mean we give up the right to enforce it later.

24. Final Acceptance

By using EthnicBNB, creating an account, searching for a stay, making a booking, listing a property, sending messages, uploading content, accepting payment, writing a review, or using any platform feature, you confirm that you have read, understood, and accepted these Terms of Service.

You also confirm that you will follow the policies that apply to your activity, including the Privacy Policy, Cancellation Policy, Payments page, Hosting Agreement, General Terms, Disclaimer, and other public rules shown on the platform.

EthnicBNB is built to support respectful travel, responsible hosting, cultural discovery, and safer booking experiences. Every guest and host is expected to use the platform honestly, lawfully, and respectfully.
